to the Sunnah and to the consensus of the leading imams.
This is one of the matters that Abū ʿAbdullāh Ibn Battah lists in al-Ibānah al-Ṣughrā (1) among the innovations that run counter to the Sunnah and the consensus. In light of this, the weakness (2) of Abū Muḥammad’s (3) proof becomes clear, for the Prophet’s ﷺ visit to Qubāʾ Mosque did not involve tightening the saddle, and travelling to it does not become obligatory through a vow.
As for his statement (4) “Mounts are not to be saddled…,” which he construes as merely a denial of recommendation, it can be answered in two ways (5):
- Even if this is conceded, it would only indicate that such a journey is neither a righteous deed, nor a devotional act, nor an obedience, nor any kind of good work. Accordingly, anyone who believes that travelling to visit the graves of the prophets and the righteous is a devotional act of worship and obedience has contradicted the consensus. And if a person actually travels on the assumption that it is an act of obedience (6), then that journey is unlawful by the unanimous agreement of the Muslims, [so the prohibition stems from his treating it as a devotional act] (7); and it is well-known that no one undertakes such travel except for that very reason.

(2) MSS F, K and T read: "butlan" (invalidity).
(3) MSS F, K and T add the name: "al-Maqdisi."
(4) MSS F, K and T further add: "bi-anna al-hadith alladhi madmunuhu" (that the hadith whose purport is…).
(5) MSS B and M read: "ʿanhu jawaban" (there are two answers regarding it), whereas MS F has: "min wajhayn" (from two angles).
(6) MSS F, K and T read: "anna dhalika" (that this…).
(7) This wording is from MSS F, K and T; MS M instead reads: "fa-sara al-tahrim min wajhayn" (thus the prohibition became two-fold).
